Brazil Establishes Public Consultation for 2026-2027 Gaming Regulatory Agenda

The Secretariat of Prizes and Betting, operating under Brazil’s Ministry of Finance, launched a public consultation on December 1, 2025, to shape its Regulatory Agenda for 2026-2027. This initiative invites contributions from citizens, industry stakeholders, and civil society organizations over a 45-day period, concluding on January 14, 2026. The consultation aims to gather diverse perspectives and will be managed through the federal Portal Brasil Participativo.

This move underlines SPA’s dedication to transparency, social involvement, and evidence-based policy-making in Brazil’s fast-evolving gaming sector. As the industry draws increased public interest, this consultation reflects a strategic effort to align regulatory processes with societal expectations.

A Structured and Participatory Approach

Guided by Article 55 of Annex I of Decree No. 11.907/2024 and Laws No. 13.756/2018 and 14.790/2023, alongside Article 29 of Decree No. 12.002/2024, the initiative is a testament to the legal and procedural rigor SPA intends to uphold. Regis Dudena, the SPA Secretary, outlines a clear process for contributions during this consultation phase.

Stakeholders are invited to submit suggestions, comments, and proposals from December 1, 2025, to January 14, 2026. Post-submission, SPA’s technical team will thoroughly analyze the contributions, with findings published by January 30, 2026. This structured timeline enhances participation, ensuring legal compliance and institutional accountability.

Role and Scope of SPA

SPA governs a wide array of gaming-related activities, positioning itself as a key player in Brazil’s regulatory landscape. Its regulatory authority spans fixed-odds betting, lotteries, equestrian competitions, promotional prize distributions, and the early capture of popular savings. This diverse mandate necessitates a comprehensive Regulatory Agenda addressing technical, operational, social, and economic issues pertinent to gambling and promotional campaigns.

Significance of the Consultation

Since the formalization of fixed-odds betting via Law No. 14.790/2023, Brazil’s gaming market has experienced noteworthy regulatory developments. Ongoing efforts focus on licensing, auditing, consumer protection, anti-fraud measures, advertising standards, and technological advancements. The current consultation seeks to capture input that will guide SPA’s focus over the coming two years, ensuring that its agenda aligns with societal interests while fostering responsible market growth and innovation.

The consultation is expected to attract contributions from a broad spectrum of stakeholders, including legal and regulatory experts, betting operators, technology providers, civil society organizations, consumer protection groups, academic researchers, industry associations, and engaged citizens. By encouraging such widespread involvement, SPA aims to enhance the democratic legitimacy of its regulatory decisions and reaffirm its commitment to collaborative rule-making.

Following the Consultation

Upon concluding the consultation, SPA’s technical analysts will evaluate all contributions following parameters outlined in Article 31 of Decree No. 12.002/2024. This evaluation will prioritize the Regulatory Agenda, identifying key themes, regulatory challenges, and strategic objectives for 2026-2027. The resulting agenda will guide SPA’s regulatory actions, offering predictability to operators, investors, and the broader gaming ecosystem.

The public consultation marks a critical juncture in the evolution of Brazil’s regulatory landscape for betting and promotional gaming. By fostering participation from various societal sectors, SPA is proactively working towards a robust, socially responsive regulatory framework aligned with national public policy goals.

As Brazil’s gaming market continues to grow, this 2026-2027 Regulatory Agenda will be crucial in setting priorities and addressing emerging challenges in responsible oversight and sustainable industry development. The diverse input gathered during this consultation will play a fundamental role in shaping a dynamic and resilient gaming sector in Brazil.
